Police charge man with throwing loaded AK-47 towards 5-month-old

30-year-old Joshua Brice Smith was arrested Saturday after police say he threw a loaded weapon towards his 5-month-old child.

In an affidavit obtained by NewsChannel 9, police say Smith was arrested after police say he physically assaulted his girlfriend.

The woman told police that Smith had badly beaten and strangled her on May 30. Snyder also said that Smith had threatened her with a loaded gun.

Police arrived at Smith's home and arrested him.

Smith is no stranger to police.

Earlier this year, He was involved in a justifiable homicide after he shot and killed a suspect during an attempted robbery.

In a police affidavit, Smith is also said to have been recently arrested for possession a large amount of methamphetamine as well as several firearms with what police call a large amount of ammunition.

Smith is being charged with multiple crimes including two counts of Aggravated Assault, False Imprisonment, Child Neglect, and Possession of a Prohibited Weapon.
