The announcement Tuesday comes a day after a separate consumer protection agreement with the same company resulting in almost $2 million for Tennessee.
The state attorney general's office said in a news release that the agreement resolves allegations that Abbott illegally marketed Depakote for 10 years ending in 2008. The release said Depakote was not deemed safe and effective for some uses by the Food and Drug Administration, and there were subsequent false claims to Medicaid and other federal health care programs.
Tennessee Attorney General Bob Cooper said his office will continue to work diligently to pursue any company attempting to illegally divert funds designated for TennCare, the state's version of Medicaid.
